Terms & Conditions
These Terms & Conditions (“Terms”) govern your use of curate.ch and purchases you make through our checkout. Last updated: 8 May 2026. They are designed for Swiss consumer e-commerce and should be read together with our Shipping, Returns, and Privacy pages.
1. Operator & scope
The online shop at curate.ch (the “Shop”) is operated for customers ordering delivery to Switzerland. By placing an order, you enter a contract of sale with the legal entity identified in our Impressum.
If you do not agree with these Terms, you must not use the Shop or complete a purchase.
2. Product information & prices
We aim to describe products accurately, including material, size, compatibility, and country of origin where relevant. Minor deviations in colour or appearance caused by screen settings do not constitute a defect.
All prices are stated in Swiss francs (CHF). Unless we explicitly say otherwise next to the price, prices for consumers include Swiss value-added tax (VAT) at the statutory rate applicable at checkout.
Additional costs (for example shipping or cash-on-delivery fees, if ever offered) are shown separately before you confirm payment.
3. Conclusion of contract
Product pages are an invitation to treat, not a binding offer. Your order is an offer. We accept it by sending an order confirmation or by delivering the goods, whichever occurs first.
We may decline orders (for example if fraud is suspected, inventory is unavailable, or export or safety rules block the sale). In that case we will not charge you, or we will refund any amount already captured.
4. Payment
Payment is due immediately at checkout through the payment methods we display (for example card payment via our payment service provider). You authorise us or our provider to charge the selected method for the total shown at checkout.
If a payment is reversed or charged back without justification, we may suspend further orders until the matter is resolved.
5. Delivery & risk
Delivery is made to the address you provide in Switzerland. Title to the goods passes when full payment is received; risk of accidental loss or damage passes when the goods are handed to the carrier, unless mandatory law provides differently.
Delivery dates communicated in marketing or on the website are estimates only, except where we have expressly confirmed a calendar delivery date in writing.
6. Right of withdrawal & returns
Swiss law does not automatically grant a right to return non-defective goods bought online. Any voluntary return right is governed exclusively by our Returns & Refunds page, which forms part of these Terms by reference.
Statutory warranty rights for defective goods remain unaffected (see below).
7. Warranty
For physical goods, the statutory warranty provisions of the Swiss Code of Obligations apply. You must inspect goods on receipt and notify us of defects within a reasonable period once you notice them.
Warranty claims may include repair, replacement, an adequate price reduction, or cancellation of the purchase, subject to legal conditions. Consumer claims for indirect or consequential damages are excluded to the extent permitted by mandatory Swiss law.
8. Liability for use of the website
We work to keep the Shop available and secure, but we cannot guarantee uninterrupted access. To the extent permitted by law, we exclude liability for slight negligence except for damage from injury to life, body, or health, or for breaches of material contractual duties.
We are not liable for third-party content linked from the Shop unless we adopt that content as our own.
9. Intellectual property
All content on curate.ch (text, graphics, logos, layouts) is protected by intellectual-property laws. You may not copy, scrape, or reuse it for commercial purposes without our prior written consent.
10. Data protection
Processing of personal data is described in our Privacy Policy, which forms part of your relationship with us.
11. Changes
We may update these Terms from time to time. The version published at the time of your order applies to that order. Material changes will be highlighted on the Shop where reasonable.
12. Applicable law & venue
These Terms are governed by substantive Swiss law, excluding conflict-of-law rules. Mandatory consumer protections at your place of residence remain reserved where they cannot be validly waived.
For disputes arising from these Terms or your purchase, the courts at the operator’s registered seat have jurisdiction unless mandatory law requires another forum. We also participate in recognised Swiss consumer dispute schemes where applicable.
